California Privacy Choices (Updated January 2025)

Update notice (2025):
This page was updated to reflect the latest California Privacy Rights Act (CPRA) regulations and California Privacy Protection Agency (CPPA) guidance, effective through 2025. These updates clarify how Nivafy honors California users’ rights to limit the use of sensitive personal information, opt out of sharing for cross-context behavioral advertising, and use browser-based Global Privacy Control (GPC) signals.

Your Privacy Choices on Nivafy

In certain U.S. states, you have the right to know if we sell your personal data. In California, you also have the right to know if we share it for cross-context behavioral advertising — and to opt out if we do.

Good news! Nivafy does not sell or “share” your personal data as those terms are defined under the CCPA/CPRA.

In some states, you also have the right to opt out of targeted advertising. We grant all of our users this ability by allowing you to adjust your in-app advertising preferences to switch off activity-based ads. You can do this in your app’s Privacy Settings under Ad Preferences.

California Residents: Your Expanded Rights

If you live in California, the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) grants you the following rights:

1. Right to Know

You can request to know:

  • The categories of personal information we have collected about you.

  • The sources of that information.

  • The purposes for which we use it.

  • The categories of third parties to whom we disclose it.

  • The specific pieces of personal information we have collected.

2. Right to Delete

You may request that we delete personal information we collected from you, subject to certain exceptions (e.g., security, fraud prevention, or legal compliance).

3. Right to Correct

You can request correction of inaccurate personal information we maintain about you.

4. Right to Limit Use of Sensitive Personal Information

California residents can ask us to restrict how we use and disclose sensitive personal information (SPI), such as precise geolocation or account credentials.
If you submit a Request to Limit, we will restrict the use of SPI to purposes necessary to provide our core services.

Please Note: If you limit SPI use, you’ll still see ads on Nivafy, but they may be less personalized. Ads may still be based on your activity within Nivafy or information you directly provide.

5. Right to Opt Out of Sale or Sharing

We do not sell or share personal information as defined under California law. However, Nivafy supports Global Privacy Control (GPC) and other browser-based universal opt-out signals, which we automatically honor as valid opt-out requests.

6. Right to Non-Discrimination

Exercising your privacy rights will not result in discrimination or reduced functionality.

How to Exercise These Rights

You can submit a request in one of the following ways:

  • Through your in-app Privacy Controls (see below).

  • By emailing us at [email protected].

  • By using the “Download My Data” or “Delete My Account” tools in your account settings.

We will verify your identity before fulfilling your request. You may designate an authorized agent to submit requests on your behalf by providing written authorization.


Your In-App Privacy Controls

Nivafy users can submit a Request to Limit:

On iOS:

  1. Tap the ⚙️ button on your Profile screen to open Settings.

  2. Scroll down to Privacy Controls and tap California Privacy Choices.

  3. Toggle on “Limit the Use of Sensitive Personal Information.”

On Android:

  1. Tap the ⚙️ button on your Profile screen to open Settings.

  2. Scroll down to Privacy Controls and tap California Privacy Choices.

  3. Toggle on “Limit the Use of Sensitive Personal Information.”

You can toggle this option off at any time to re-enable personalized experiences.

Note: This setting applies only to users who are verified California residents.

CCPA/CPRA Privacy Notice

Definition of “Resident”
Under the California Code of Regulations, a “resident” includes individuals who are in California for more than a temporary or transitory purpose and those domiciled in California but temporarily outside the state.

Collection and Use of Personal Information
We may collect personal information in the following contexts:

  • When you interact with customer support.

  • When you participate in surveys, promotions, or contests.

  • When you use our services, make purchases, or contact us directly.

Sharing of Personal Information
We may share personal information with service providers under written contracts that restrict use to business purposes only. Such sharing does not constitute “selling” personal information under the CCPA.

Past Twelve Months
In the past 12 months, Nivafy has not sold or shared personal information for monetary value or for cross-context behavioral advertising.


Verification and Authorized Agents

When you submit a request, we will verify your identity using the information linked to your Nivafy account.
If you designate an authorized agent, we require proof of authorization before processing the request.
