Nivafy’s Counterfeit Policy Overview

Prohibition of Counterfeit Goods

Nivafy strictly prohibits the sale or promotion of counterfeit goods on our platform. We are committed to ensuring that our marketplace remains authentic and trustworthy.

Definition of Counterfeit Goods

Counterfeit goods are items, including digital goods, that use a trademark or brand name identical to or substantially indistinguishable from a registered trademark or brand, without the brand owner’s authorization. These goods deceive consumers into believing they are purchasing genuine products or misrepresent themselves as faux, replicas, or imitations of the original product.

Difference from Nivafy’s Trademark Policy

While Nivafy’s trademark policy addresses the unauthorized use of trademarks that could mislead or confuse about brand affiliation, the counterfeit policy specifically targets the sale or promotion of counterfeit goods.

Violations of the Counterfeit Policy

Violations include, but are not limited to:

  • Sale or promotion of non-genuine products that impersonate as genuine products of the trademark or brand owner.
  • Products advertised as faux, replicas, or imitations using a trademark or brand name without the brand owner’s permission.
  • Offering, promoting, selling, or facilitating unauthorized access to content, including digital goods.

Response to Counterfeit Reports

Upon receiving a report of counterfeit activity, Nivafy will:

  • Review the report thoroughly.
  • Take appropriate actions which may include suspending the account or disabling access to the infringing material.

For advertisers on Nivafy

Violating this policy may lead to rejection of promoted content and potential removal from the Nivafy advertising platform.

Non-Violations:

Providing news, information, or commentary about goods or services is not a violation of this policy.

Promotion or sale, including resale, of genuine branded goods may not be a violation.

Misleading use of trademarked materials not involving the sale or promotion of counterfeit goods falls under the trademark policy, not the counterfeit policy.

Consequences of Policy Violation

Violating Nivafy’s counterfeit policy can lead to account suspension. In severe cases, immediate permanent suspension may occur. If you believe your account was suspended in error, you have the option to appeal the decision.

Nivafy is dedicated to maintaining the integrity of our marketplace and protecting the rights of brands and consumers. We encourage our community to adhere to these guidelines and report any suspected counterfeit activity.
