Overview

Intellectual Property Rights Respect:

At Nivafy, we are committed to respecting intellectual property rights, which include both copyright and trademark laws. A trademark typically consists of a word, logo, phrase, or design that distinguishes the goods or services of its holder in the marketplace. Trademark laws aim to prevent unauthorized or confusing usage of these marks.

Violations of Trademark Policy:

Using another entity’s trademark in a manner that may mislead or confuse people about your affiliation with the trademark holder could be a violation of Nivafy’s trademark policy. This includes any usage that might imply a false association or endorsement by the trademark holder.

Non-Violations of Trademark Policy:

Not all references to a trademark constitute a violation. Examples include:

• Using a trademark in a region or for a class of goods/services that is outside the scope of the trademark’s registration.
• Nominative or other fair uses, such as comparative advertising, parody, or academic reference.

Reporting Trademark Violations:

Trademark violation reports are investigated only when submitted by the trademark holder or their authorized representative (e.g., legal counsel or brand representative).

To establish a violation under the Lanham Act for either a registered mark under 15 U.S.C. § 1114, or an unregistered mark under 15 U.S.C. § 1125(a), you must demonstrate that:

(1) you have a valid and legally protectable mark;

(2) you own the mark; and

(3) the use of the mark to identify goods or services causes a likelihood of confusion.

Provide all requested information. Incomplete reports may cause delays, as we may need to follow up for additional information.

Note: We may share your name and the details of the report with the account holder involved in the alleged violation.

Consequences of Violating Trademark Policy:

If an account is found to be in violation of our trademark policy, Nivafy may take actions including, but not limited to, suspending the account. The response will depend on the nature of the violation:

In some cases, you may be given an opportunity to rectify the violation and comply with our policies.

In more severe cases, particularly with egregious or repeat violations, an account may be permanently suspended immediately.

Appealing a Suspension:

If you believe your account was suspended in error under this policy, you can appeal the decision by submitting an appeal through our designated process.
